Since he has already alleged discrimination due to unlawful employment practices, he will next go to the EEOC office. The EEOC will seek out the facts of the case from both sides and attempt a resolution. Failing a resolution, the person can continue the case and file a suit. In the first phase of the suit, the person filing the case (the plaintiff) must establish a prima facie case of discrimination. This is done by showing disparate treatment or adverse impact.
